近日,话题“人去世了微信朋友圈会消失吗”在网上引发关注。记者16日从微信确认,从今年9月开始,微信对长时间不使用的微信账号已不再进行回收处理,不活跃账号的朋友圈内容同样不会清理。
A recent online debate over whether a person's WeChat Moments disappear after death has drawn wide attention. WeChat confirmed on Thursday that since September, it has stopped reclaiming long-inactive accounts, and their Moments content will remain preserved.
针对朋友圈为什么没有二次编辑和访客功能,微信公关总监“@微信粥姨”10月15日在播客中表示,微信朋友圈不会有访客功能,“微信在涉及产品逻辑的时候不希望给大家增加更大的社交压力。”
此外,朋友圈不太可能出二次编辑功能,她指出:“朋友圈是记录一个人的历史,一个人的人生是没有办法回去修改的,所以也不好让人轻易去篡改自己的编年史。”
In a podcast on Wednesday, WeChat's head of public relations said the platform will not introduce visitor-tracking or post-editing features, explaining that "Moments record a person's life — it shouldn't be something that can be easily rewritten."
如果直系亲属离世,想要拿回他的账号可以有什么办法?华南师范大学法学院副教授、广东数据资产登记合规委员会委员马颜昕表示,在生活中,很多人可能会通过拿到去世亲属手机的方式,登录、访问他的互联网平台的账号。
但他也指出:“关于账号的继承和处置,还有很多值得讨论的地方。例如,逝者账号里的聊天记录、通讯录等,可能涉及逝者不愿意家属了解的信息或第三人隐私;同时,这些数据也被法律专家认为,由于人格性过强、不产生直接的经济价值等原因,不具备独立的财产属性;此外,在一些法律实践中,逝者直系亲属,对于账号内数据的归属和处置,也可能产生争议。”
Ma Yanxin, associate professor at South China Normal University's School of Law, noted that while some families access a deceased relative's account using their phone, managing such accounts is complex. Chat histories and contact lists may involve privacy concerns or third-party information, and such data, being highly personal and non-economic, is generally not considered a property right, he said.
有网友谈到,如果做了类似“三天可见”的设置,家属拿回账号就能更好怀念逝者。对此,主流法律意见认为,逝者对朋友圈内容设置可见时间、范围,属于逝者生前另有安排的内容,受到《中华人民共和国个人信息保护法》的保护。
不过,可能很多用户在设置时并没有考虑过去世后的情况,这个议题有待继续讨论。
Some netizens suggested that "three-day visibility" settings could help relatives remember loved ones. Legal experts noted that such settings are protected under China's Personal Information Protection Law, but most users likely never considered posthumous scenarios, leaving the issue open for further discussion.
对外经贸大学数字经济与法律创新研究中心主任许可表示:“因为平台账号资源有限、安全策略等,对不活跃账号进行回收,是互联网平台的通行策略。这一次,出于逝者纪念的需求,微信对不活跃账号不执行回收策略,迈出了重大的一步。”
他也强调:“关于逝者账号的移交、继承及逝者近亲属对个人信息查阅、删除等问题,还需要法律、伦理专家、平台、有关部门共同参与,深入讨论,制定有温度、合法合规且有可操作性的合同安排和法律规范。”
Xu Ke from the University of International Business and Economics said reclaiming inactive accounts is common among internet platforms for resource and security reasons. "By choosing not to recycle inactive accounts to honor memorial needs, WeChat has taken a meaningful step forward," he said, adding that issues such as account inheritance and relatives' access rights require joint efforts by legal, ethical, and policy experts to establish "humane, lawful, and practical" guidelines.
